Agreement to Terms

By opting in to receive SMS messages from Esai Designs ("Company," "we," "us," or "our") through our Maggie notification service, you agree to these SMS Terms and Conditions ("Terms"). Please read these Terms carefully before providing your consent to receive text messages.

Service Description

Maggie is a personal productivity notification service that sends SMS alerts to help you stay on track with your daily tasks, goals, and schedule. Messages may include:

• Morning briefings with your daily schedule and priorities
• Task reminders and deadline notifications
• Goal tracking updates and accountability alerts
• Evening recaps summarizing your day's accomplishments
• Weekly planning summaries and reflections
• Service-related announcements and updates

Consent and Opt-In

By providing your mobile phone number and checking the consent box on our opt-in form, you expressly consent to receive recurring automated SMS messages from Esai Designs at the phone number you provided. Your consent is not a condition of any purchase.

Message Frequency

Message frequency varies based on your service configuration. You can expect:

• Daily messages: 2-5 messages per day (morning briefing, reminders, evening recap)
• Weekly messages: 1 additional message for weekly planning (typically Sunday)
• Total: Approximately 5-15 messages per week

Message frequency may increase temporarily during periods of high activity or important deadlines.

How to Opt Out

You may opt out of receiving SMS messages at any time using any of the following methods:

• Contact us using the information at the bottom of this page

After opting out, you will receive one final confirmation message confirming your unsubscription. You will not receive any additional marketing messages unless you re-subscribe.

Our SMS service is compatible with all major U.S. carriers, including but not limited to:

• AT&T
• Verizon Wireless
• T-Mobile
• Sprint (now part of T-Mobile)
• U.S. Cellular
• And most regional and prepaid carriers

Carriers are not liable for any delayed or undelivered messages

Privacy

Your privacy is important to us. We collect and use your phone number solely for the purpose of providing the Maggie notification service. We do not sell, rent, or share your phone number with third parties for marketing purposes.

User Responsibilities

By using our SMS service, you agree to:

• Provide a valid mobile phone number that you own or are authorized to use
• Update us if your phone number changes
• Ensure your mobile device can receive SMS text messages
• Not use the service for any unlawful or prohibited purpose

Service Availability

While we strive to deliver messages promptly, we cannot guarantee:

• Delivery of messages to all carriers or devices
• Specific delivery times for messages
• Uninterrupted service availability

Message delivery is subject to effective transmission by your wireless carrier. We are not liable for any delays or failures in message delivery caused by carrier networks or technical issues beyond our control.

Limitation of Liability

To the maximum extent permitted by law, Esai Designs shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the SMS service
• Any delays or failures in message delivery
• Any errors or inaccuracies in message content
• Any actions you take based on messages received

Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms on this page with a new effective date. Your continued use of the SMS service after such changes constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
